1. Who operates this site

istefox.dev and the Agentwake app are operated by Stefano Ferri, an independent software developer based in Italy ("I", "me"). You can reach me atstefferri@icloud.com. By using this site or Agentwake you accept these terms. If you do not accept them, do not use the site or the app.

2. Scope

These terms cover the istefox.dev website (including the blog and project pages) and the Agentwake macOS application, in both its free and paid (Pro) tiers, including the beta program described in section 6. How I handle personal data is described separately in thePrivacy Policy.

3. Agentwake: Free and Pro

Agentwake is distributed as a signed and notarized DMG for macOS 14 or later. The free tier (including the keyboard-cleaning lock and live agent status) requires no payment and no account. The Pro tier is unlocked by a license key and adds the features listed on theproduct page.

A Pro license is a personal, non-exclusive, non-transferable right to use Agentwake Pro on Macs you own or control. It is a one-time purchase: no subscription, and all updates are included for the life of the product. You may not resell, sublicense, or share your license key, and you may not reverse engineer the app except where the law expressly permits it.

4. Purchases

Polar Software Inc. ("Polar") processes all purchases as merchant of record. This means your sales contract for the payment itself is with Polar: Polar handles the checkout, payment processing, invoicing, and applicable taxes, and emails you the license key. Polar's own terms and privacy policy apply to the checkout. I remain responsible for the app itself and for these terms.

Pricing: Agentwake Pro costs €3.99 for the whole of September 2026 and €7.99 from 1 October 2026 onward. Prices are stated in euro, taxes handled by Polar at checkout. A price never moves back down once it has risen, and every date is published in advance on the product page.

5. Refunds

If Pro is not for you, write tostefferri@icloud.com within 14 days of purchase and you get a full refund, no questions asked. This sits alongside, and does not limit, any mandatory rights you have as a consumer under EU and Italian law.

6. Beta program

Until 31 August 2026 you can join the Agentwake beta by signing up with your email on the product page. Beta testers receive the current build and a free lifetime copy of Pro, activated through a private checkout link delivered by email. The link is personal, works once, and the offer is capped at a limited number of redemptions.

The purpose of the beta is to gather feedback before the public launch. Beta builds are pre-release software: they are stable and have been in development and testing for about six months, but features may still change and occasional defects are to be expected. Feedback is welcome throughGitHub Issues or by email; providing feedback is appreciated but never a contractual obligation.

7. Updates

Agentwake updates itself through the Sparkle framework: the app checks for a new version, verifies its signature, and installs it. Updates are included with both tiers at no extra cost. I may add, change, or retire individual features over time; a feature you paid for will not be removed from Pro without a functional replacement.

8. Acceptable use

You may not use this site or the app to break the law, to probe or disrupt the site's infrastructure, or to circumvent the licensing mechanism. Automated bulk scraping of the site, beyond normal search-engine and AI-assistant indexing, is not permitted.

9. Intellectual property

Agentwake, its name, and the content of this site (text, images, screenshots, code samples) belong to me unless stated otherwise. Third-party names mentioned on the site (such as Amphetamine, Adrafinil, Agent Caffeine, Vigil, Claude Code, or Apple trademarks) belong to their respective owners and are used only to identify the products in question.

10. Warranty and liability

The free tier and beta builds are provided "as is", without warranty, to the extent the law allows. For paid licenses, the legal guarantee of conformity under EU and Italian consumer law applies in full. Nothing in these terms excludes or limits liability for intent, gross negligence, or any liability that cannot be excluded by law. Beyond that, my liability is limited to the amount you paid for the license.

One point specific to what Agentwake does: the app is designed fail-safe, so a missed signal lets your Mac sleep rather than keeping it awake. Still, you remain responsible for supervising long unattended workloads and for your own backups.

11. Governing law and disputes

These terms are governed by Italian law. If you are a consumer in the European Union, you also keep the protection of the mandatory rules of your country of residence, and you may bring disputes before the courts of your own country as EU law provides. For everyone else, the competent court is the one of my registered residence in Italy.

12. Changes to these terms

I may update these terms as the product and the law evolve. The "last updated" date at the top always reflects the current version, and substantive changes to paid features or refund rights will be announced on the product page before they take effect. Continued use after a change means you accept the updated terms.
